These Terms of Use (“Terms & Conditions“) govern your use of our mobile application, products, services, communications, features, apps, technologies, content, websites, and software provided by or related to us and our affiliates hereinafter collectively referred to as “Platform“, made available by Rigel Networks Pvt. Ltd. (“RNPL“, “Company“, “we“, “us” and “our“), a private company established under the laws of India having its registered office 702/6/7 Dwarkesh Complex, R.C.Dutt Road, Vadodara Gujarat 390007. The terms “you” and “your” refer to the user of the Platform. The terms “Terms & Conditions” refers to Terms of Use, Privacy and Community Guidelines for the user of the Platform.
Our Services (as we have described below in detail) and these Terms are compliant with the Indian Penal Code, 1860, and Information Technology Act, 2000, including all amendments made to it and rules framed under it. When you use our Platform, you accept and agree to these Terms. However, please note that we do not represent that we are compliant with laws of any country apart from India. If you wish to use our Services, please ensure that you are permitted to do so, in your jurisdiction. You are required to follow certain rules while you use our Platform. We have listed all Terms, Privacy, Community Guidelines and all other rules in this document. Please note that by using our Platform, you agree to everything mentioned in this document. If you are using these services outside India, please comply with your local laws. Company makes no representation that Products are appropriate or available for use in all locations. Products may not be available in your location, and deliverables may vary among locations. You represent and warrant that, You are authorized to accept everything mentioned in this document to indemnify Company for any and all violations of these Terms.
Our Platform lets users of the Platform to stream mobile screen content, do audio and video group calls, record audio calls, create gallery and albums with photos and videos, post contents, create channels and seasons, create calendar events and much more, all collectively is “User Content”. Our products aim to help you find and connect with people, groups, businesses, organizations, and others. Our products may be global in nature. When you publish any User Content on the Platform, you retain whatever ownership rights in that content you had to begin with. However, you grant us a license to use that content. You also grant other users the right to share/ communicate such User Content for a limited private or non-commercial use alone. Any User Content will be considered non-confidential. You must not post any User Content on or through the Services or transmit to us any User Content that you consider to be confidential or belonging to third parties, or in violation of applicable laws. We aim to bring people together and improve quality of life. As part of this mission, we provide various products and services described below to you. We may provide a personalized experience for you. We may use the data we have – for example, about the connections you make, the choices and settings you select, and what you share and do on to personalize your experience. We may help you find and connect with people, groups, businesses, organizations, and others and may use the data we have to make suggestions for you and others. There can be many ways to communicate using Platform for example, sending or sharing status updates, communicating messages, photos, video, screensharing and more. You might send messages to a friend or several people, create events or groups, or add content to your profile. We also have developed, and continue to explore, new ways for people to use technology and communicate. We may show you ads, offers, and other sponsored content. Our partners may pay us to show their content to you. We seek to deploy and maintain systems to detect misuse of our products, harmful conduct towards others, and situations where we may be able to help support or protect the community. If we learn of content or conduct like this, we will take appropriate action – for example, offering help, removing content, blocking access to certain features, disabling an account, or contacting law enforcement. We share data with others when we deem it reasonably necessary when we detect misuse or harmful conduct by someone using one of our products. We work to improve our products. For example, we may analyze data and understanding how people use our products. To do so, we may need to store and distribute content and data in our data centers and systems around the world, including outside your country of residence. This infrastructure may be operated or controlled by Company or its affiliates or contractors. When you submit User Content through the Services, you agree and represent that you own that User Content, or you have received all necessary permissions, clearances from, or are authorized by, the owner of any part of the content to submit it to the Services, to transmit it from the Services to other third-party platforms, and/or adopt any third party content. If you only own the rights in and to a sound recording, but not to the underlying musical works embodied in such sound recordings, then you must not post such sound recordings to the Services unless you have all permissions, clearances from, or are authorized by, the owner of any part of the content to submit it to the Services. You grant us a worldwide, royalty-free, sublicensable, and transferable license to host, store, use, display, reproduce, modify, adapt, edit, publish, and distribute any User Content. This license is for the limited purpose of operating, developing, providing, promoting, and improving the Services and researching and developing new ones. You also grant us a perpetual license to create derivative works from, promote, exhibit, broadcast, syndicate, publicly perform, and publicly display User Content in any form and in any/all media or distribution methods (currently known or later developed). To the extent it is necessary, when you appear in, create, upload, post, or send User Content, you also grant us unrestricted, worldwide, perpetual right and license to use your name, likeness, and voice, including in connection with commercial or sponsored content. This means, among other things, that you will not be entitled to any compensation if your data is used by us for marketing, advertising, or improving our Services. While we are not required to do so, we may access, review, screen, and delete your content at any time and for any reason, including to provide and develop the Services or if we think your content violates these Terms as well as for purposes as mandated by applicable laws. You alone, though, remain responsible for the content you create, upload, post, send, or store through the Service. You further acknowledge and agree that we may generate revenues, increase goodwill or otherwise increase our value from your use of the Services, including, by way of example and not limitation, through the sale of advertising, sponsorships, promotions, usage data, and except as specifically permitted by us in these Terms or in another agreement you enter into with us, you will have no right to share in any such revenue, goodwill or value whatsoever. You further acknowledge that, except as specifically permitted by us in these Terms or in any another agreement you may enter into with us, you have no right to receive any income or other consideration from any content that you publish on the Platform or your use of any musical works, sound recordings or audio-visual clips made available to you on or through the Services, including in any User Content created by you. If you are a composer or creator or author of a video or musical work and are affiliated with a performing rights organization, then you must notify your performing rights organization of the royalty-free license you grant through these Terms in your User Content to us. You are solely responsible for ensuring your compliance with the relevant performing rights organization’s reporting obligations. If you have assigned your rights to a music or video publisher, then you must obtain consent from such music publisher to grant the royalty-free license(s) set forth in these Terms in your User Content or have such music publisher enter into these Terms with us. Authoring a musical or video work (e.g., wrote a song, created a movie) does not necessarily give you the right to grant us the licenses in these Terms. If you are a recording or creator artist under contract with a record label, then you are solely responsible for ensuring that your use of the Services is in compliance with any contractual obligations you may have to your record label, including if you create any new recordings or video through the Services that may be claimed by your label. We use the information we have, to study our Service and collaborate with third parties for research purposes in order to make our Service better and contribute to the well-being of our community.
You may use our Services only if you are capable of forming a binding agreement with us and are legally permitted to use our Services. If you are accepting these Terms on behalf of a company or any legal persons, then you represent and warrant that you have the authority to bind such entity to these Terms and effectively “you” and “your” shall refer to the company. Please ensure that you are allowed to use our services under the law. To use our Service, you simply need to run the mobile application on your mobile phone. You can register using your email. You may further verify yourself using a One-Time-Password sent by us via SMS to your phone number. We also allow you to download content that is available on our Platform and share your experience across social media platforms. You cannot use Products if, you are under 13 years old, we previously disabled your account for violations of our terms or policies and you are prohibited from receiving our products, services, or software under applicable laws. You agree not to engage in the conduct or facilitate or support others in using our products to violate these Terms, industry acceptable Community Standards, and other terms and policies we may adopted, add, or modify from time to time, that apply to your use of Platform. Conduct that is unlawful, misleading, discriminatory or fraudulent, that infringes or violates someone else’s rights including any intellectual property (patent, trademark, copyright, or trade secret) rights. You may not upload viruses or malicious code or do anything that could disable, overburden, or impair the proper working or appearance of our products. You may not access or collect data from our products using automated means (without our prior permission) or attempt to access data you do not have permission to access. If reasonably possible, we may remove or disable content you communicate in violation of these provisions and, if applicable, we may take action against you or your account. We may also disable your account if you repeatedly infringe other people’s intellectual property rights. To help support our community, we encourage you to report content or conduct that you believe violates your rights (including intellectual property rights) or our terms and policies. You grant Company a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content. This means, for example, that if you communicate a photo on Platform, you give us permission to store, copy, and share it with others such as service providers that support our service or other Products you use. Even content you delete may persist for a limited period of time in backup copies (though it may not be visible to other users). In addition, content you delete may continue to appear if you have communicated it with others and they have not deleted it. You give us permission to use your name and profile information in connection with ads, offers, and other sponsored content that we may incorporate with our products, without any compensation to you. You give us permission to download and install upgrades, updates, and additional features. If you use or communicate content covered by intellectual property rights that we have and make available in our products (for example, images, designs, videos, or sounds we provide that you add to content you create or share on Platform), we retain all rights to that content. You can only use our copyrights or trademarks (or any similar marks) with our prior written permission. You must obtain our written permission (or permission under an open source license) to modify, create derivative works of, decompile, or otherwise attempt to extract source code from us. Our aim is to foster a positive and inclusive community and provide amazing social experiences for all users. You will not use the Services for any purpose that is fraudulent, misleading, illegal or prohibited in these Terms. You will not use any robot, spider, crawler, scraper, or other automated means or interface to access the Services or extract other user’s information. You will not use or develop any third-party applications that interact with the Services or other users’ content or information without our written consent. You will not use the Services in a way that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services, or that could damage, disable, overburden, or impair the functioning of the Services. You will not post content that can be considered to infringe any Intellectual Property rights of any third party. You will not falsely represent yourself as another person or representative of another person to use our Services. You will not use or attempt to use another user’s account, username, or password without their permission. You will not solicit login credentials from another user. You will not post content that may be considered as harmful to minors. You will not post content that contains or links to pornography, graphic violence, threats, hate speech, or incitements to violence. You will not upload viruses or other malicious code or otherwise compromise the security of the Services. You will not attempt to circumvent any content-filtering techniques we employ or attempt to access areas or features of the Services that you are not authorized to access. You will not probe, scan, or test the vulnerability of our Services or any system or network. You will not post any content that in any way or form threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation. You will not encourage or promote any activity that violates these Terms. You will not circumvent any feature, action, measure, or policy implemented/ imposed by us. For example, in the event you are banned from using the Services, you will not try to circumvent any account suspension or similar measures we may take against you. Please note that you will solely bear the costs and consequences of any actions taken by you on the Platform. You will not falsely represent yourself as another person or representative of another person to use our Services. We may disable or suspend your profile or take other relevant action if you provide us with incorrect information. We have implemented measures to ensure that our Platform is secure. However, there is no guarantee that our Platform is immune to hacking and virus attacks. You will ensure that you have requisite anti-malware and antivirus software on your mobile device and computer to ensure its safety. While we do everything we can to secure your use of our Services, keep in mind that we cannot contemplate all forms of attack on our Platform. You should, as a matter of practice, ensure that your mobile device and computer are not used wrongly or tampered with in any way. If any of our users report your content which violates this document, we may remove such content from our Platform. In the event that multiple reports are made regarding violation, we may be compelled to terminate your account with us and block you from registering with us. If you wish to appeal any such removal, you may write to us at grievance@unifiedway.co
You must correctly identify the nature of the content shared by you and tag it appropriately. You shall not, however, use our Platform to share any content which is obscene, pornographic, harmful for minors, discriminatory, spreading what may be considered as hate speech, inciting any form of violence or hatred against any persons or violates any laws of India, or is barred from being shared by any laws of India. We reserve the right to remove such content. We may share your information with appropriate law enforcement authorities if we have good-faith belief that it is reasonably necessary to share your personal data or information in order to comply with any legal obligation or any government request; or to protect the rights or prevent any harm to our property or safety, our customers, or public; or to detect, prevent or otherwise address public safety, fraud, security or technical issues. You understand however, that we cannot be held responsible for any actions done by or to you by a third party or user by way of using our Platform. We have developed a platform for people to engage in amazing social experiences; please do not share any content which is illegal or causes any harm to the well-being of members of the society or community.
We strongly believe in the freedom of expression and allow you to share videos on our Platform. We do not have any ownership over any of the content shared by you and the rights in the content remain only with you. You will not use our Platform to violate or infringe upon our or any third-party’s intellectual property rights and such content may be removed from the Platform. Further, if you use any content developed by us, then we shall continue to own the intellectual property rights vested in such content. By sharing/posting/uploading content using our Services, you grant us (and our Group and Affiliates) a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, run, copy, display, translate, or create derivative works of your content (consistent with your privacy and application settings) for purposes such as for providing, upgrading or improving the services, marketing, promoting you/ the services or for displaying your content on any service made available by us or the Group. You may delete your content and/or account at any point. This will result in your User Content also being deleted from other such variants. However, your content may continue to appear on the Platform if it has been shared with others. Moreover, we may retain your User Content and other data for a limited period so as to restore your account should you choose to reinstate your account. You remain solely responsible for the content you post on our Platform. We do not endorse and are not responsible for any content shared or posted on or through our Platform, and for any consequences resulting out of such sharing or posting. The presence of our logo or any trademark on any content shared by you does not mean that we have endorsed or sponsored your content. Further, we will not be liable for or responsible for the consequences of any transactions made or entered into by you with other users of the Platform or advertisers on the Platform. You will always have ownership and responsibilities for the content you share. We will never claim that we have intellectual property rights over your content, but we will have a zero cost, permanent license to use what you share and post on our Platform. We are an intermediary as defined under the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. These Terms are published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 that require publishing of the rules and regulations, the Privacy Policy, and Terms of Use for accessing and using our Platform. Our role is limited to providing a platform for users to upload, share and display content, created or shared by you and other users. We do not control what you or other people may or may not do on the Platform and are thus, not responsible for the consequences of such actions (whether online or offline). We are not responsible for services and features offered by others, even if you access them through our Services. Our responsibility for anything that happens on our Platform is strictly governed by the laws of India and is limited to that extent. You agree that we will not be responsible for any loss of profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising to you or any other person related to these Terms, even if we know they are possible. This includes when we delete your content, information, or account. We are an intermediary under Indian law. We do not control what people post on our Platform but we expect adherence to Terms & Conditions. We have developed a community-driven platform. Therefore, you agree to not interfere with, or use non-public areas of our Platform, Services, and our technical delivery system. You will not introduce any trojans, viruses, any other malicious software, any bots or scrape our Platform for any user information. Additionally, you will not probe, scan, or test the vulnerability of any system, security or authentication measures implemented by us. If you tamper or attempt to tamper with our technological design and architecture, we will terminate your user profile and ban you from using our services. We may further report such actions to the appropriate law enforcement authorities and proceed against you with legal actions. You will not hack into or introduce malicious software of any kind onto our Platform. If you commit such actions, we may remove you from the platform and may report your actions to the police and/or relevant legal authorities. We collect the content, communications and other information you provide when you use our products, including when you sign up for an account, create or communicate content, and message or communicate with others. This can include information in or about the content you provide (like metadata), such as the location of a photo or the date a file was created. Our systems may automatically process content and communications you and others provide to analyze context and what’s in them. You can choose to provide information in your Platform profile such as religious views, political views, who you are “interested in,” or your health. This and other information (such as racial or ethnic origin, philosophical beliefs or trade union membership) could be subject to special protections under the laws of your country. We may collect information about the entities you communicate or interact with or are connected to. We may also collect contact information if you choose to upload, sync or import it from a device (such as an address book or call log or SMS log history), which we use for things like helping you and others find people you may know and for the other purposes. We may collect information about how you use our products, such as the types of content you view, communicate, or engage with; the features you use; the actions you take; the people or accounts you interact with; and the time, frequency and duration of your activities. For example, we may log when you are using and have last used our products, and what you view with our products. If you use our products for purchases or other financial transactions (such as when you make a purchase in a game or make a donation), we may collect information about the purchase or transaction. This includes payment information, such as your credit or debit card number and other card information; other account and authentication information; and billing, shipping and contact details. We may also receive and analyze content, communications and information that other people provide when they use our products. This can include information about you, such as when others communicate with or about you, send a message to you, or upload, sync or import your contact information. As described below, we may collect information from and about the computers, phones, connected TVs and other web-connected devices you use that integrate with our products, and we combine this information across different devices you use. For example, we may use information collected about your use of our products on your phone to better personalize the content or features you see when you use our products on another device, such as your laptop or tablet, or to attempt measure whether you took an action in response to an ad we showed you on your phone on a different device. We may collect information such as the operating system, hardware and software versions, battery level, signal strength, available storage space, browser type, app and file names and types, and plugins. Information about operations and behaviors performed on the device, such as whether a window is foregrounded or backgrounded, or mouse movements (which can help distinguish humans from bots). We may collect unique identifiers, device IDs, and other identifiers, such as from games, apps or accounts you use, and Family Device IDs. We may collect Bluetooth signals, and information about nearby Wi-Fi access points, beacons, and cell towers. We may collect information you allow us to receive through device settings you turn on, such as access to your GPS location, camera or photos. We may collect information such as the name of your mobile operator or ISP, language, time zone, mobile phone number, IP address, connection speed and, in some cases, information about other devices that are nearby or on your network. We may collect data from cookies stored on your device, including cookie IDs and settings. Advertisers, app developers, and publishers can send us information. Such information may include information about your device, websites you visit, purchases you make, the ads you see, and how you use their services whether or not you have a Platform account or are logged into Platform. We may also receive information about your online and offline actions and purchases from third parties who have the rights to provide us with your information. Partners may receive your data when you visit or use their services or through third parties they work with. Partners should have lawful rights to collect, use and share your data before providing any data to us. We may make your experience more seamless, for example, by automatically filling in registration information (such as your phone number) from one Platform product when you sign up for an account on a different product. We may use location-related information-such as your current location, where you live, the places you like to go, and the businesses and people you’re near-to provide, personalize and improve our products, including ads, for you and others. Location-related information can be based on things like precise device location (if you’ve allowed us to collect it), IP addresses, and information from your and others’ use of Products (such as check-ins or events you attend). We may use the information we have to develop, test and improve our products, including by conducting surveys and research, and testing and troubleshooting new products and features. If available, we may use face recognition technology to recognize you in photos, videos and camera experiences. We may use the information we have about you-including information about your interests, actions and connections-to select and personalize ads, offers and other sponsored content that we show you. We may use the information we have (including your activity off our products, such as the websites you visit and ads you see) to help advertisers and other partners measure the effectiveness and distribution of their ads and services, and understand the types of people who use their services and how people interact with their websites, apps, and services. We may use the information we have to verify accounts and activity, combat harmful conduct, detect and prevent spam and other bad experiences, maintain the integrity of our products, and promote safety and security on and off of Products. For example, we may use data we have to investigate suspicious activity or violations of our terms or policies. We may use the information we have to send you marketing communications, communicate with you about our products, and let you know about our policies and terms. We may also use your information to respond to you when you contact us. Your information may be communicated as communication on Products, When you share and communicate using our products, you may choose the audience for what you communicate, for example, a person, a group, all of your friends, the public, or a customized list of people. Public information can be seen by anyone, on or off our products, including if they don’t have an account. This may include your username; any information you share with a public audience; information in a public profile on Platform. Public information can also be seen, accessed, reshared or downloaded through third-party services such as search engines, APIs, and offline media such as TV, and by apps, websites and other services that integrate with our products. You should consider who you choose to communicate with, because people who can see your activity on our products may choose to share it with others on and off our products, including people and businesses outside the audience you shared with. People can also use our products to create and communicate information or content about you with the audience they choose. People in your networks may see information indicating whether you are active on our products, including whether you are currently logged in or when you last used our products. When you choose to use third-party apps, websites, or other services that use, or are integrated with, our products, they may receive information about what you post or share. Devices and operating systems providing native versions of Products may have access to all information you choose to communicate, including information your friends share with you, so they can provide our core functionality to you. If the ownership or control of all or part of our products or their assets changes, we may transfer your information to the new owner. We may work with third-party partners who help us provide and improve our products or who use Platform to grow their businesses, which makes it possible to operate our companies and provide products to people around the world. We may provide aggregated statistics and insights that help people and businesses understand how people are communicating. We may provide advertisers with reports about the kinds of people seeing their ads and how their ads are performing, but we avoid sharing information that personally identifies you (information such as your name or email address that by itself can be used to contact you or identifies who you are) unless you give us permission. We share information about you with companies that aggregate it to provide analytics and measurement reports to our partners. We may provide information and content to vendors and service providers who support our business, such as by providing technical infrastructure services, analyzing how our products are used, providing customer service, facilitating payments or conducting surveys. We may also provide information and content to research partners and academics to conduct research that advances scholarship and innovation that support our business or mission, and enhances discovery and innovation on topics of general social welfare, technological advancement, public interest, health and well-being. We may share information with law enforcement or in response to legal requests. You may have the ability to access, rectify, port and erase your data. We may store data until it is no longer necessary to provide our services and Products, or shortly after your account is deleted – whichever comes first. This is a case-by-case determination that depends on things like the nature of the data, why it is collected and processed, and relevant legal or operational retention needs. If you delete your account, we may delete things you have communicated, such as your photos and status updates, and you won’t be able to recover that information later. Information that others have shared about you isn’t part of your account and won’t be deleted. We may access, preserve and share your information with regulators, law enforcement or others. When we have a good-faith belief it is necessary to: detect, prevent and address fraud, unauthorized use of the products, violations of our terms or policies, or other harmful or illegal activity; to protect ourselves (including our rights, property or products), you or others, including as part of investigations or regulatory inquiries; or to prevent death or imminent bodily harm. For example, if relevant, we provide information to and receive information from third-party partners about the reliability of your account to prevent fraud, abuse and other harmful activity on and off our products. Information we receive about you (including financial transaction data related to purchases made with Platform) can be accessed and preserved for an extended period when it is the subject of a legal request or obligation, governmental investigation, or investigations of possible violations of our terms or policies, or otherwise to prevent harm. We also retain information from accounts disabled for terms violations for at least a year to prevent repeat abuse or other term violations. We may share information globally, both internally within the Companies, and externally with our partners and with those you connect and share with around the world in accordance with this policy. While our Platform is a freely accessible and usable platform, we need to generate revenue so that we can keep offering you our Services for free. Pursuant to this, we may share any data that we may collect including but not limited to your username, profile pictures, your usage and engagement habits and patterns on our Platform. We will not, however, be liable to pay you any revenue share if you purchase any products seen to you. We do not endorse any products or vouch for the authenticity of the products. Merely promoting of products by the users on our Platform does not amount to an endorsement by us. If we share any sensitive personal information (as defined under the applicable laws) we will ask you for your consent prior to sharing the same. We are constantly updating our Platform and Services offered. To use our Platform, you may need to download the mobile application to your mobile device and update it from time to time. Applications and software are constantly updated for your use and you will need to install the latest version of the mobile application to your mobile device each time such update is generated. We may use cookies, pixel tags, web beacons, mobile device IDs, flash cookies and similar files or technologies to collect and store information with respect to your use of the Services and third-party websites. We shall have the right to retain certain information regarding your usage of the Platform. You grant us the right to process, store and retain information relating to you and provided by you. As part of the Platform, we provide several feature which allows you to communicate via call, chat, publish and broadcast real-time videos of yourself and your cast your mobile screen on the Platform. All the content uploaded or shared by you must conform to terms. We reserve the right to immediately remove or suspend any feature and /or take other such actions that may be relevant. If any such removal/termination/suspension action has been taken against you, you may appeal the action through the app report mechanism or you may write to us at grievance@unifiedway.co. We may, from time to time, add, remove, or alter the functionalities. We have evolving features on our Platform, and we may add/remove or modify the existing attributes of the feature from time to time. We do not give any assurances stating that all features will be error-free or always available for your use or all functionalities will be available at all times or any content posted by other users using the Platform will be accurate. However you shall not misuse the features. As a responsible user, please flag/report any aspect that you come across and that may be in violation of applicable laws and terms. Taking these measures will ensure a safer and better experience for everyone on the Platform. You may make use of the app reporting mechanism to report information that is abusive or offensive and/or report the Livestream itself. We collect your phone number and request access to the SMS on your phone by sending you a One-Time-Password (“OTP”), which you confirm by entering the OTP to confirm your identity, while registering with our Platform. We access the contacts list on your mobile device. We always ask for your consent before accessing your contacts list and you have the option to deny us the access to your contacts list. We collect what information when you disclose certain location information to us and to other Platform users when you access the Platform, as we derive location information from your IP address, device, or internet service for providing the Services or improving our platform such as to ensure that there are no multiple log-ins on your account. We use information that you provide to our customer support team regarding any assistance or support that you may require for using our Platform from time to time. We collect device information such as the operating system, operating system version and language, hardware and software versions, device company and model, screen resolution, battery level, signal strength, device RAM, device bitrate, available storage space, information pertaining to the device CPU, browser type, app and file names and types, and plugins. We collect device information about operations and behaviors performed on the device, such as whether a window is foregrounded or backgrounded. When you submit, post or share the content that you choose to make public on the Platform, it may be re-shared by others. You should consider who you choose to share it with, because people who can see your activity on our Platform can choose to share it with others on and off our Platform, including people outside the audience you shared it with. Users can also use our Platform to create and share content about you with the audience that they choose, such as posting a photo of you, or tagging you in any of their posts. We reserve the right to share all public content on any social media site or any other online or offline platform. We will never rent or sell your Personal Information to third parties, except on an anonymized basis, unless expressly provided in these Terms. We may share information that you share with us including your Personal Information with any member of our Group. The term “Group” shall mean any entity that is controlled by us, or any entity that is in control of us, or any entity that is under common control with us, whether directly or indirectly. When you share content and communicate using our Platform, you choose the audience for what you share. For example, when you post any content from our Platform on Facebook, you select the audience for the post, such as a friend, a group of friends or all of your friends. We do not control and shall not be liable for the manner, in which such persons with whom you choose to share content via any sharing options or other service providers and integrated platforms, available on the Platform use the information that you share with them. We may share your information including Personal Information with select third parties including: business partners, suppliers and sub-contractors collectively called as Affiliates. Affiliates may use this information to help provide, understand, and improve the Service and Affiliates’ own services for the performance of any contract we enter into with you. Government bodies or law enforcement agencies, if we have good-faith belief that it is reasonably necessary to share your personal data or information in order to comply with any legal obligation or any government request; or to protect the rights or prevent any harm to the property, or safety of the Company, our customers, or public; or to detect, prevent or otherwise address public safety, fraud, security or technical issues.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your Personal Information, we cannot guarantee the security of your data transmitted to the Platform; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access. You are free to remove or delete content from your user account/profile and your account/ profile at any point in time. However, the history of your activities and account on our Platform remains available to us. You may correct, amend, add or delete Personal Information from your account at any time by logging in and visiting your profile page. As noted above, you may opt out from unwanted e-mail communications from us by following the instructions in the message. However, until your account is deleted you will continue to receive all system e-mails. For deleting your account from the Platform and removing user data, please go to the settings of your App and click on the ‘Delete Account’ option. We do not retain your Sensitive Personal Information (defined below in this paragraph) for longer than is required for the purposes for which the information may be lawfully used. For any other content, we will entertain your request for deletion, however, there is a strong possibility that copies of any public content will be retained indefinitely in our systems, including in cached and archived pages of the Platform, or if other users have copied or saved that information. In addition, due to the nature of the internet, copies of your content, including content that you have removed or deleted from your account, may also exist elsewhere on the Internet and be retained indefinitely. The Platform may, from time to time, contain links to and from the websites of our partner networks, Affiliates and/or any other websites or mobile applications. Please check these policies before you submit any personal data to these websites or mobile applications.
You should contact us via security@unifiedway.co when you think there may be a security vulnerability in Platform; unsure about how a known vulnerability affects a Platform; and you want to provide feedback about our standards of service and performance. Only members of the Security Response Team, a restricted and carefully chosen group of employees, will have access to material sent to security email address. No outside users can subscribe to this list. Please provide as much information about your system and the issue as possible when contacting the list. Any information you share with us about security issues that are not public knowledge is kept confidential unless otherwise required by law. It is not passed on to any third-party without your permission unless otherwise required by law. We may from time to time send you service-related announcements when we consider it necessary to do so (such as when we temporarily suspend the Platform for maintenance, or security, privacy, or administrative-related communications). We send these to you via SMS. You may not opt-out of these service-related announcements, which are not promotional in nature and used solely to protect your account and keep you informed of important changes to the Platform.
Our Platform connects you with people from across India and other parts of the world. The community that we have created is diverse and receptive to a variety of content but the Platform is accessed by a variety of audience, which may include minors and young adults. Hence, in order to ensure that all our users follow a standard practice and to foster a safe environment for you to creatively express yourselves, we have put in place strict guidelines and restrictions which govern the usage of the Platform. We shall actively remove content which is not allowed on our Platform and violates both our Guidelines as well as applicable Indian laws. If such content comes to our attention, we may take it down or ban user accounts. If you come across any content that violates these Guidelines, we encourage you to report it. The intent of the creator is important. We understand the importance of creative freedom, however we do not welcome content that intends to bring discomfort, spread what may be considered hate speech and abuse, promotes violence and illegal activities or impedes the creator or artist ecosystem on the Platform. All content, including without limitation, content that is uploaded, posted, commented on, or shared by you on our Platform, must adhere to the laws of India, including without limitation, the Indian Penal Code,1860 and, the Information Technology Act, 2000 along with all rules and amendments made under such laws. We cooperate with legal authorities and follow enforcement mechanisms in cases of breach of applicable laws. Content may not be uploaded, posted, commented on, or shared by you if it threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign States, or public order. You may not post or engage with content that is insulting to any other nation, incites the commission of any offences or prevents the investigation of offences. We allow content that may have limited sexual imagery, provided it is posted for artistic and educational purposes, public awareness, humor or satirical purposes. Content which contains the following is prohibited on the Platform and will be considered as a strict violation of these Guidelines: Obscene, sexually explicit, pornographic or nude material or images/videos that expose private parts (sexual organs, female breasts and nipples, buttocks) and/or portray sexual activities; videos or images of people in compromising positions or content which portrays sexual actions or fetish or erotic intent or sexual arousal; sextortion or revenge pornography; Bestiality or zoophilia; content that exploits or endangers any person (for example, listing of phone numbers, or other personal information aimed at any exploitation or endangerment of a person including for the purposes of encouraging or soliciting prostitution or escort services); Content that is pedophile or related to child pornography (including without limitation, creation, promotion, glorification, transmission or browsing of child pornography); or content that is indecent, immoral or related to on rape, sexual objectification, non-consensual activities and molestation. We strongly condemn any kind of harassment or bullying on our Platform. We intend to give our users the freedom to express themselves without the fear of emotional or psychological distress. We urge you to ignore any content that you may find petty and annoying. In addition to this, we also encourage you to report any such content that harasses another person or intends to degrade or shame any individual. Content which qualifies as a violation of these Guidelines includes, but is not limited to: Posting abusive language or curse words, morphed images, and/or malicious recordings; Objectifying, insulting or harassing someone based on their race, caste, color, disabilities, religion, sexual preferences and /or making sexual advances or otherwise engaging in sexual misconduct will not be tolerated on this Platform. Similarly, extorting or blackmailing any individual otherwise or on the basis of the abovementioned content is strictly prohibited. If someone blocks you from their account, kindly do not try and contact them from a different account. If a user does not want to engage with you on the Platform, we urge you to respect the same and vice versa. You should not post any image or information of a person that is shared without their consent with an intent to harass, distress or endanger them or any false information posted to harass someone for financial gain, or cause any injury to them. However, if a matter involves critical discussion and deliberation of such individuals who are featured in the news or tend to have a large public audience, we may allow it subject to the Terms and these Guidelines. We aim to safeguard intellectual property rights and consider violations of such rights as serious misconduct. All content such as literary, musical, dramatic, artistic, sound recordings, cinematographic works, is subject to intellectual property protection. Posting content on the Platform which is not original and is copied from an individual/organization who owns the intellectual property rights in such content/works is not allowed. Any content which violates the intellectual property rights of third parties will be taken down and strict action will be taken against users who are repeat defaulters. If you wish to reshare such content from within the Platform, kindly do not remove any attributions, watermarks and original captions which state the authentic source of the content. In addition to this, please take the required permissions and give due credits to your fellow users or any other organization/individual who own the intellectual property rights in such content by mentioning their name and /or the original source. Violence includes all content that causes discomfort to our users due to the goriness in the content, such as but not limited to graphical images or videos that glorify violence and suffering, or intends to incite violence, depiction of physical violence or animal cruelty. Content which promotes dangerous and illegal activities, or praises individuals, groups or leaders involved in terrorism, organized violence or criminal activities is strictly prohibited. Educative or informative content pertaining to violence may be allowed on the Platform. Violent content on the Platform in the form of fictional set-up, martial arts may be permitted subject to these Guidelines. Content that promotes violent behavior against an individual or a group of individuals, intends to intimidate, target or demean any particular religion, race, caste, ethnicity, community, nationality, disability (physical or mental), diseases or gender, is prohibited. Any kind of content which produces hatred or has the intention of creating or spreading hatred or hate propaganda along the lines of including, but not limited to religion, caste, ethnicity, community, sexual orientation or gender identity is also not allowed. We do not entertain content that spreads discrimination, intends to justify violence based on the above-mentioned attributes and refers to an individual or a group of individuals as inferior in any sense or with negative connotations. We urge you to refrain from incendiary commentary and publishing theories or hateful ideologies that may cause outrage to our users and influence them negatively. We may permit such content which intends to raise awareness about these issues or challenge it, subject to clear intention of posting such content on the Platform. We do not permit content that exhibits suicide or such tendencies, triggers self-injury and harm or encourages participation in dangerous activities. Posting any content that relates to physical, mental, sexual, or psychological maltreatment, neglect or abuse of any person, be it that of a child or an adult, is strictly condemned. Content showcasing self-harm, glorifying self injury or suicide or even stating instructions on how to commit self-harm through any means is not allowed. Further, content that identifies, tags, attacks and negatively targets or makes fun of victims and survivors of psychological/physical maltreatment, abuse, self-injury or domestic abuse or any other form of violence is prohibited. We allow content that intends to provide support, aid and relief to those undergoing such serious issues. We also allow users to share their experiences which may provide coping mechanisms for those who need help, subject to the intent of posting such content. We have zero-tolerance for content that advocates or promotes illegal activities. We prohibit content related to organized crime, criminal activities, promotion/sale/use of weapons, firearms and explosives, violence or terrorist activities. Sale of illegal goods or services, regulated goods, drugs and controlled substances, and soliciting or selling of sexual services is strictly forbidden. We do not permit content that is harassing, harmful, or abusive to children. Users may not post content that is related to or encourages money laundering or gambling. Users are not allowed to post content that displays tutorials or instructions or educates the users about illegal and prohibited activities including, but not limited to participating in criminal activities, making bombs or encouraging or doing or trading in drugs. Do not use our Platform to solicit or facilitate any transaction or gift involving such goods and services which are declared illegal by the Government of India. Impersonating another person (such as your family, friends, celebrities, brands or any other individuals/organizations) and distributing false or misleading information on our Platform in order to make personal or financial gain will be considered fraud. Content that contains computer viruses, malware, or any other computer code designed to restrict the functionality of any computer resource cannot be uploaded on the Platform. Posting or misusing personal content or data or information of another person, including pictures or videos of other people who have not given express consent to such material being posted, is not allowed. Do not post anyone’s personal or intimate photos or videos without their permission or consent. Do not post content that is invasive of anyone’s privacy. We will remove such content. Revealing someone’s personal data or sensitive personal information, including without limitation: contact information, address, financial information, Aadhar Number, healthcare information, sexual or intimate images and videos, passport information, or threatening someone to reveal or use such information, will be considered as harassment, and such activities are strictly unacceptable. Content which misleads users about its origin, displays or promotes false advertisements, fraudulent or misleading representations and security breaches, falls under the ambit of spam. Such content, when posted for commercial gain, amounts to commercial spam. Spam interferes with the smooth functioning of the Platform and deters other users from sharing and connecting. It is important that the content you share is authentic and facilitates the creation of a safe and trusted environment for people to post on the Platform. Do not post the same content multiple times if it intends to annoy viewers or sell goods/services in order to promote spam, commercial or otherwise. Do not use artificial and manipulative means to generate traffic or increase followers, likes, views, comments and shares. If you want to promote your goods or services, we urge you to do so in an authentic manner. We aim to combat the spread of misinformation on our Platform. Any kind of content which spreads deliberate misinformation, disinformation, hoaxes or fake propaganda, with the intent to mislead the users or general public at large, is not permitted. We prohibit posting of content that exaggerates an existing piece of news by introducing non-factual elements into it. We do not allow content on the Platform that misleads users or attempts to create an avenue for fabricating content, or is defamatory, libelous, or attempts to damage someone’s reputation, or hurt their financial or political standing on the basis of incorrect information. We engage third party fact checkers to combat the menace of fake news basis which we proactively warn our users that a piece of content is found to be factually incorrect. We urge you to take the same into consideration and act accordingly. However, we do not confuse fake news with any satire or parodies. We allow for such content on the Platform provided the content does not mislead other users and the intent behind the same is not to spread false information. When you use our Platform, we expect you to follow certain norms. All posts should be tagged with the most appropriate tag. If such a tag doesn’t exist, then create one accordingly. Any content posted with an irrelevant or inapplicable tag, if reported, will be removed from the feed. Make sure that any content that you post, and any discussion you participate in, relates to the caption and tags of the post. Content that does not relate to the caption or tags, or is unreasonable for a particular post, will be removed. Do not go off-track. Creating a fake profile of an individual or organization and impersonating someone in a misleading or deceiving manner, with or without the intention of harassing or bullying them, is not allowed. We permit exceptions for community profiles, informative profiles and fan profiles of public figures. Satire or parody accounts of public figures are also permitted as long as the intention is not to mislead other users and the same is clearly mentioned in the profile description or profile status. Harassing someone or using abusive language in the posts or comments while addressing another user is not allowed. Do not do anything which may make other users feel uncomfortable. Action will be taken against you if you try to create hostile situations for other users. Ignorance of law is not an excuse to escape liability for your actions. In order to use our Platform, you will need to comply with laws and regulations that govern conduct in the digital environment. Kindly respect all applicable laws while using our Platform. Any content featuring, encouraging, offering, promoting, glorifying or soliciting illegal activities will not be tolerated. Our decision to suspend any account is binding upon the user. Any attempt to circumvent the suspension by creating other accounts, identities, personalities or presence on another user’s account will also result in suspension. If you try to evade suspension, we may be compelled to terminate your account with us and block you from registering with us. When you see any content or activity that violates these Guidelines, please tap or click on the Report. When you report content, we will process and review the content. If we find the content or activity to be unsuitable for our Platform, we will remove it. If you believe any content on the Platform infringes your rights as a copyright holder, you can file a copyright claim using our grievance mechanism and the same will be sent to our team for further review and action. There may be such content on the Platform which you do not like but the same does not violate these Guidelines. In that case, we request you to either unfollow or block such users.
The rights and obligations under these Terms are granted only to you and shall not be assigned to any third party without our consent. However, we are permitted to assign our rights and obligations under these Terms to others. This can happen when, for example, we enter into a merger with another company and create a new company. In all cases, you agree that disputes will be subject to the laws of India and the courts of Vadodara shall have exclusive jurisdiction over all such disputes.
If we determine that you have violated our terms or policies, we may take action against your account to protect our community and services, including by attempting to suspend access to your account or disabling it. We may also suspend or disable your account if you create risk or legal exposure for us or when we are permitted or required to do so by law. Where appropriate, we will notify you about your account the next time you try to access it. If you delete or we disable your account, these Terms shall terminate as an agreement between you and us, but the provisions hereafter including Limitation of Liability and Disputes will remain in place. We do not assume any liability with respect to any loss or damage, arising directly or indirectly due to any inaccuracy or incompleteness of any information or a breach of any warranty or guaranty due to the actions of any user of the Platform. The Platform and Services, are provided on “as is” and “as available” basis without any representation or warranties, express or implied except otherwise specified in writing. We make no guarantees that they always will be safe, secure, or error-free, or that they will function without disruptions, delays, or imperfections. We do not warrant the quality of the Services or the Platform including its uninterrupted, timely, secure or error-free provision, continued compatibility on any device, or correction of any errors. In no event shall we, or any of our affiliates, successors, and assigns, and each of their respective investors, directors, officers, employees, agents, service providers, and suppliers be liable for any special, incidental, punitive, direct, indirect or consequential damages suffered as a consequence of a breach of the Terms by another user or arising out of the use of or the reliance on any of the Services or the Platform. In the event any exclusion contained herein is held to be invalid for any reason and we or any of our affiliate entities, officers, directors or employees become liable for loss or damage, then, any such liability shall be limited to not exceeding Indian Rupees One hundred or amounts paid to us for use of the Platform or the Services in past month preceding the date of the claim. We seek to provide the best products we can and to specify clear guidelines for everyone who uses them. We do not control or direct what people and others do or say, and we are not responsible for their actions or conduct (whether online or offline) or any content they share (including offensive, inappropriate, obscene, unlawful, and other objectionable content). We cannot predict when issues might arise with our products. Accordingly, our liability shall be limited to the fullest extent permitted by applicable law, and under no circumstance will we be liable to you for any lost profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to these Terms or the Products, even if we have been advised of the possibility of such damages. We try to provide clear rules so that we can limit or hopefully avoid disputes between you and us. If a dispute arises, however, it’s useful to know up front where it can be resolved and what laws will apply. You agree to indemnify, defend and hold harmless us, and our subsidiaries, affiliates and agents and their respective officers, directors, employees, successors and assigns from and against any claim, proceeding, loss, damage, liability, cost, demand or expense (including but not limited to attorney’s fees) of any kind arising out of: your access to or use of the Platform and Services; any breach by you of your obligations under this Agreement; your violation of the rights of any third party, including any infringement of intellectual property, or of any privacy or consumer protection right; any violation of law or contractual obligation and any claims, demands, notices pursuant to such violation; your negligence or willful misconduct and in any case whatsoever. This obligation will survive the termination of our Terms. These Terms make up the entire agreement between you and Company regarding your use of our products. They supersede any prior agreements, whether written, oral, or otherwise. Some products may be governed by supplemental terms. If you use any of those products, supplemental terms will be made available and will become part of our agreement with you. To the extent any supplemental terms conflict with these Terms, the supplemental terms shall govern to the extent of the conflict. If any portion of these Terms are found to be unenforceable, the remaining portion will remain in full force and effect. If we fail to enforce any of these Terms, it will not be considered a waiver. Any amendment to or waiver of these Terms must be made in writing and signed by us. You will not transfer any of your rights or obligations under these Terms to anyone else without our consent. You may designate a person (called a legacy contact) to manage your account if it is memorialized. Only your legacy contact or a person who you have identified in a valid will or similar document expressing clear consent to disclose your content upon death or incapacity will be able to seek disclosure from your account after it is memorialized. These Terms do not confer any third-party beneficiary rights. All of our rights and obligations under these Terms are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise. You should know that we may need to change your account in certain circumstances (for example, if someone else claims the username and it appears unrelated to the name you use in everyday life). We always appreciate your feedback and other suggestions about our products and services. But you should know that we may use them without any restriction or obligation to compensate you, and we are under no obligation to keep them confidential. The rights and obligations under the terms and conditions of previous versions of Platform which were provided by any other provider of the Platform have been assigned to Company. If any aspect of these Terms is unenforceable, the rest will remain in effect. Any amendment or waiver to our Terms must be in writing and signed by us. If we fail to enforce any aspect of these Terms, including reporting any illegal or impermissible actions to appropriate law enforcement authorities or blocking or suspending your profile, such failure to enforce our rights will not be a waiver by us. As part of our commitment to the privacy and safety of our users, we continue to work alongside the government authorities to keep our users safe. We have put together a robust Grievance Redressal Mechanism in place to help resolve any concerns or complaints raised by you with respect to the Platform. We will resolve the issues raised by you within 15 (fifteen) days from receiving them. We have created a method for you to get in touch with us via grievance@unifiedway.co and for us to address your concerns. We reserve all rights not expressly granted to you. Our Platform is dynamic and may change rapidly. As such, we may change the services we provide at our discretion.
